What is a Felony in the State of Texas?
In the State of Texas, a felony is considered a serious crime. Fines for felonies can be upwards of $10,000, but the more pressing issue is that those convicted of a felony can serve up to life in prison.
Types of Felonies in Texas
In the State of Texas, there are five different levels of felonies. Each has its own charges and each comes with its own set of punishments. The five types of felonies are capital felonies, first-, second-, and third-degree felonies, and then something referred to as state jail felonies.
Capital Felonies:
Murder is probably the clearest example of a capital felony. Those found guilty of murder can face life in prison or be sentenced to death.
First-Degree Felonies:
Aggravated assault, robbery, or kidnapping are examples of first-degree felonies. Punishment for these or similar offenses include imprisonment for anywhere from five to 99 years, up to life in prison.
Second-Degree Felonies:
Second-degree felony crimes include arson, indecent contact with a child, or an improper relationship between educator and student. If found guilty, the offender can face anywhere from two to 20 years in prison.
Third-Degree Felonies:
These include crimes such as deadly conduct with a firearm, stalking, or a third DWI offense. This type of felony is punishable with a fine up to $10,000 and two to 10 years in jail.
State Jail Felonies:
Crimes such as burglary of a building, cruelty to animals, or forging a check all fall under state jail felonies. Offenders can face up to two years in jail with fines also upwards of $10,000.
